Petitioners in these petitions are seeking to enlarge them on bail in Cr.No.4/2025 of Srirampura Police Station, Chitradurga, registered for offences punishable under Section 189(2), 191(2), 191(3), 352, 109, 54, 115(2), 118(1), 74, 351(2) r/w 190 BNS, 2023. 3. Aforementioned crime is registered on a complaint lodged by Rangamma W/o Mallikarjunappa against 25 named accused persons. It is alleged that regarding performing pooja at Veera Maranna temple of their village, there is a long standing dispute existing between the two parties. Since 8 years, the complainant’s party was performing pooja as per Court order. Due to the said enmity, on 3.1.2025, at about 7.00 p.m., all the - 7 - NC: 2025:KHC:8158 CRL.P No. 2080 of 2025 C/W CRL.P No. 2099 of 2025 CRL.P No. 2166 of 2025 AND 1 OTHER accused formed an unlawful assembly armed with chopper, sickle, stick, stones etc., and assaulted the complainant and others causing injuries to them and also threatened them with dire consequences etc. 4. It is stated, the injured took treatment at Community Health Centre, Kittadalu and further treatment at Government Hospital, Hosadurga. 5. FIR is registered against accused Nos.1 to 25. The complainant in his further statement has named 15 more accused. The accused were arrested on 4.1.2025 and they are in judicial custody. 6. Petitioner in Crl.P.No.2080/2025 is accused No.28, Petitioners in Crl.P.No.2099/25 are accused Nos.6, 34 and 35, petitioners in Crl.P.No.2166/2025 are accused Nos.30 and 37 and petitioner in Crl.P.No.2187/2025 is accused No.3. 7. Allegations against accused No.3 is that he has instigated the mob to assault the complainant and others. - 8 - NC: 2025:KHC:8158 CRL.P No. 2080 of 2025 C/W CRL.P No. 2099 of 2025 CRL.P No. 2166 of 2025 AND 1 OTHER Allegations against accused No.6 is that she dragged one billappa and knocked him on the ground. The allegations against accused Nos.28 and 34 are that they have dragged the complainant and one Parvathamma and assaulted them with hands and kicked them. Allegations against accused No.30 is that he assaulted complainant’s brother-in-law, Billappa with stick. Accused Nos.35 and 37 are alleged to have assaulted complainant’s son Maranna with hands and also kicked him with legs. 8. In respect of the very same incident, there is a counter complaint lodged by one Veerabhadraiah, arraigned as accused No.12, which is registered in Cr.No.5/2025 at Srirampura Police Station, Chitradurga, against 20 named accused for offences punishable under Section 189(2), 191(2), 191(3), 352, 115(2), 118(1), 351(2) and 190 of BNS, 2023. Some of the accused in the present case are alleged to have sustained injuries in the incident. - 9 - NC: 2025:KHC:8158 CRL.P No. 2080 of 2025 C/W CRL.P No. 2099 of 2025 CRL.P No. 2166 of 2025 AND 1 OTHER 9. The injuries sustained by the victims in the present case are said to be simple in nature and they are discharged from the hospital. It appears that on account of the dispute with regard to performing pooja, both the parties got involved in a quarrel and assaulted each other, as a result of which two cases came to be registered against each other. It is submitted that the accused in the counter case are enlarged on bail. 10. Name of accused Nos.28, 30, 34, 35 and 37 are not in the FIR. It is contended by the learned counsel that the petitioners are falsely implicated on account of a long standing civil dispute between the parties, with regard to performance of pooja and administration of the temple. 11. The learned High Court Government Pleader has contended that the charge sheet is yet to be filed and therefore, if the petitioners are enlarged on bail, they may tamper with the prosecution witnesses. Hence, the following: ORDER I. Petitions are allowed. II. Petitioners/accused No.28-Smt. Suvarnamma in Crl.P.No.2080/25, accused No.6-Smt.Sunandamma, accused No.34-Smt.Vanalakshmi and accused No.35-Sri Mallikarjuna in Crl.P.No.2099/2025, accused No.30- Mr.K.C.Bhadrappa @ Veerabhadrappa and accused No.37- Krishnamurthy @ Krishnaraja in Crl.P.No.2166/2025 and accused No.3-Bhupal Ajjappa @ Ajjappa in Crl.P.No.2187/2025 are ordered to be released on bail in Cr.No.4/2024 of Srirampura Police Station, Chitradurga,, subject to following conditions: 1.
