Neutral Citation No. - 2025:AHC:78852-DB Court No. - 39 Case :- WRIT - C No. - 14115 of 2025 Petitioner :- Saurabh Singh Gangwar Respondent :- Lokayukta Uttar Pradesh And 7 Others Counsel for Petitioner :- Chandra Bhan Gupta Hon'ble Arindam Sinha,J. Hon'ble Avnish Saxena,J.
1. Mr.Chandra Bhan Gupta, learned advocate appears on behalf of petitioner and submits, inter alia, respondent nos.4 and 5 demanded bribe from his client. Complaint dated 15th June, 2022 has made to the Lokayukt. There was report on inquiry directed but without waiting for it, the Lokayukt closed the complaint case, as informed to his client by communication dated 11th July, 2024, under challenge.
2. On query Mr.Gupta submits, demand for bribe was made. It was not actually paid but the demand itself amounts to corruption.
3. We are not inclined to direct issuance of notice on the Lokayukt nor private respondents. This is because for establishing an offence, both demand for and payment of bribe is to be proved on evidence. Mere allegation that there was demand for bribe is insufficient evidence, reason given for closing the complaint case.
4. In view of aforesaid, no order can be made on the writ petition.
5. Mr.Gupta reiterates, report on inquiry has not yet been filed. In event, it is and petitioner finds from it, corroboration on his allegation, he may once again move this Court.
6. The writ petition is disposed of. Order Date :- 14.5.2025 LN Tripathi (Arindam Sinha,J.) (Avnish Saxena,J.) Digitally signed by :- LALIT TRIPATHI High Court of Judicature at Allahabad
