1. This is an ofÏce reference.
2. This Court, vide order dated 05.08.2024, passed in MCRC No. 5520 of 2024, while rejecting the bail to the applicant, namely, Ravi Yadav had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of four months from the date of receipt of a certified copy of this
order, if there was no legal impediment.
3. The learned Special Judge (NDPS Act) Raipur, District-Raipur,
2 (C.G.) vide his request letter dated 30.11.2024 has requested for grant of six months time for concluding the trial.
4. It transpires from perusal of the PUD, that in this case, according to the list of evidence presented by the prosecution, statements of a total of 33 witnesses are yet to be recorded, but so far, statements of only 04 witnesses have been recorded. Due to the accused having different advocates, cross-examination takes more time, resulting in only one witness's statement being recorded per day, causing delay in recording statements of all witnesses.
5. The concerned trial Court has been issuing bailable warrant/ arrest warrant on each hearing date to ensure the presence of prosecution witnesses. Despite this, currently, examination of 29 main prosecution witnesses are pending, making it impossible to conclude the trial within the stipulated timeframe. Therefore, she prays for grant of further six months time for concluding the trial.
6. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of six months from today.
7. Accordingly, this CRMP stands disposed off with the aforesaid direction.
8. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
