JUSTICE PARTHA SARTHY ORAL ORDER 2 03-06-2025 1. Heard learned counsel for the parties. 2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Nagar P.S. Case no. 655 of 2023 registered under sections 279, 337 and 427 of the Indian Penal Code and section 37(b) of the Bihar Prohibition and Excise Act, 2016. 3. As per the prosecution case, a driver who was driving the jeep in a drunken condition dashed against a motorcycle. The driver was caught at the place of occurrence and handed over to the police and an F.I.R. was registered. 4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case only for the reason that he happens to be the owner of the vehicle which was being driven by the driver and which had dashed against the Patna High Court CR. MISC. No.34342 of 2025(2) dt.03-06-2025 2/2 motorcycle. Neither the petitioner was arrested at the spot nor has he any criminal antecedent. 5. The application for anticipatory bail is opposed by learned A.P.P. for the State. 6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R., the petitioner not having been arrested at the spot and not having any antecedent under the Bihar Prohibition and Excise Act, 2016, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Nagar P.S. Case no. 655 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-I, Begusarai. avinash/- (Partha Sarthy, J) U T
