Heard Mr. Himanshu Pandey, learned counsel for the petitioner. Also heard Mr. Y.S. Thakur, learned Additional Advocate General, appearing for the State / respondent Nos. 1 & 3, Mr. Shobhit Mishra, learned counsel, appearing for respondent No.2, Mr. Gary Mukhopadhyay, learned counsel, appearing for respondent No.4 and Mr. Animesh Tiwari, learned counsel, appearing for respondent No.5. 2. The present petition has been filed by the petitioner under Article 226 of the Constitution of India with the following prayers :- “10.1 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, order, direction quashing the disqualification of the Petitioner in tender process. 10.2 That, this Hon'ble Court may kindly be pleased to quash the order pertaining to opening of tender dated 19/11/2024 and direct the Respondent authorities to consider the participation of the Petitioner in tender process. 10.3 That, this Hon'ble Court may kindly be pleased to direct the Respondent authorities to re evaluate the tender process transparently and fairly in accordance with law. 10.4That, this Hon'ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.” 3. Learned counsel for the petitioner submits that he wants to withdraw the instant petition and for which he has already filed an application for withdrawal of the petition. 3 4. Learned counsel, appearing for the respective respondents have no objection. 5. Accordingly, the application for withdrawal of the petition is allowed and instant petition is dismissed as withdrawn without any further liberty. 6.
