Nellore Mandal, Chittoor District by the unofficial respondents, which is abutting the land hold in possessed by the petitioner and obstructing the right of passage, without issuing any notice to the petitioner, without following the due process of law, is highly illegal, arbitrary, violation of Principles of Natural Justice and in violation of Articles 14 and 300-A of the Constitution of India and consequently direct action of the respondents not to erect the Ambedkar Statue in respect of land in Sy.No.325 to an extent of Ac.1.22 cents situated at Kotagaram Village, G.D. M.S.BANU PRASAD RAO The Court made the following: RC,J W.P.No.23840 of 2023 4 ORDER This Writ Petition is filed questioning the inaction of the respondents in preventing the official respondents from erecting Ambedkar Statue in an extent of Ac.1-22 cents of land in Survey No.325 of Kotagaram Village, G.D.Nellore Mandal, Chittoor District, by obstructing the right of passage of the petitioner to reach his land situated abutting the land wherein the statue is proposed to be installed. 2. Sri Balakrishna, learned Assistant Government Pleader for Panchayat Raj, on written instructions of the Tahsildar dated 19.09.2023 submitted that pursuant to the complaint made by villagers, the authorities visited the locality and found that Dr.Ambedkar Statue was installed without obtaining any permission from authorities and the villagers were asked to remove the statue for which the villagers consented and removed the statue from that place and as of now the subject land is free from encroachments. 3. Sri Pasala Sudhakar Reddy, learned counsel for the petitioner, prayed this court to close the writ petition recording the contents of the written instructions referred to by the learned Assistant Government Pleader. 4. In view of the above, this writ petition is closed. Needless to observe that the authorities have to take steps for removal of statues installed without RC,J W.P.No.23840 of 2023 5 obtaining any permission from the competent authorities.
