The petitioner has preferred the present petition with the prayer to direct the respondent No.2/Additional Commissioner (Food), Varanasi Division, Varanasi to decide the Appeal No.61 of 2022 under Section 13(2) U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 expeditiously. 3. It is argued by learned counsel for the petitioner that the matter is pending before the Court below since long and considerable time has already been lapsed but till date no final decision has been taken in the matter and prays to direct the respondent No.2 to decide the aforesaid appeal expeditiously. 4. Learned counsel for the respondents have no objection. 5. Heard learned counsel for the parties and pureed the record. 6. In the facts and circumstances of the case, the present petition is disposed of directing the respondent No.2/Additional Commissioner (Food), Varanasi Division, Varanasi to decide the aforesaid appeal strictly in accordance with law most expeditiously and preferably within a period of four months from the date of production of certified copy before him but without granting unnecessary adjournment unless there is no legal impediment.
