Neutral Citation No. - 2025:AHC:66294 Court No. - 5 Case :- WRIT - A No. - 5137 of 2025 Petitioner :- Vimla Respondent :- State of U.P. and Another Counsel for Petitioner :- Dinesh Kumar Counsel for Respondent :- C.S.C.,Harshit Pandey Hon'ble Ajay Bhanot,J. The petitioner is the wife of the deceased-employee. The revised pension and consequential benefits to which the deceased-husband is entitled have not been released to her. She has made a representation before the competent authority but to no avail. The only prayer made by Shri Dinesh Kumar, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Harshit Pandey, learned counsel for the respondent No.2 submits that the matter requires determination of
facts by the competent authority in light of the applicable provisions of law in the first instance. However, he fairly contends that her claim regarding revised pension and consequential benefits to which the deceased-husband is entitled, is liable to be decided by the competent authority in a reasonable time frame. In wake of the submissions made at the Bar and without going into the merits of the case, the respondent No.2-
Nagar Ayukta, Kanpur Nagar Nigam, Kanpur Nagar is
directed to decide the representation of the petitioner regarding her claim for revised pension and consequential benefits to which the deceased-husband is entitled as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
