Mr. Gaurav Singh, Advocate for the applicant. 2. Mr. Siddharth Bisht, A.G.A. with Mr. Himanshu Sain, B.H. for the State. 3. Applicant-Himanshu Baiharwal is in jail in connection with F.I.R. No.116 of 2025 dated 05.03.2025, under Sections 20/60/8 of Narcotics Drugs and Psychotropic Substances Act, 1985 registered with Police Station Bahadrabad, District Haridwar. 4. As per the F.I.R. the applicant was intercepted by the Police and was found carrying 4 kg. of ganja in a gunny bag. 5. It is contended by learned counsel for the applicant that alleged recovery from the applicant is false and moreover, the recovery so made is less than commercial quantity, which according to appended table to the N.D.P.S. Act, is 20 kg. 6. It is further submitted by learned counsel for the applicant that the applicant has no criminal history, which too, is pointed out in the rejection order dated 24.03.2025, passed by the Special Judge (N.D.P.S.), Haridwar. 7. Per contra, learned State counsel has no dispute that the contraband substance, which was allegedly recovered from the applicant, is less than commercial quantity and the applicant has no criminal history as well. 8. Having considered the submission advanced by learned counsel for the applicant, this Court is of the view that this is a fit case to enlarge the applicant on bail. 9. Let the Applicant-Himanshu Baiharwal be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
