1. By the present writ petition, the petitioner is seeking a direction towards the respondent Nos.2 & 3 to take a decision about the seized paddy of the petitioner by the Krishi Upaj Mandi Samiti, Pithora. 2. Learned counsel for the petitioner submits that the respondent/ Krishi Upaj Mandi Samiti has seized 252 quintal paddy from the house & godown and 152 quintal paddy from the shop of the petitioner alleging illegal storage of paddy and the same is still with the Krishi Upaj Mandi Samiti, Pithora. He submits that the petitioner approached the Krishi Upaj Mandi Samiti for release of the paddy which was seized on 14/11/2024. He further submits that the Secretary, Krishi Upaj Mandi Samiti has sent a communication to the SDO vide Anenxure P-5 dated 2/01/2025 stating that after the seizure of the paddy, it has been requested to the District Collector, Food Branch to take a decision and for necessary action about the seized paddy from the house, godown and shops of the petitioner. He further submits that the petitioner submitted a representation before the respondent No.2-Collector, Mahasamund and respondent No.3-Sub-Divisional Officer (Revenue) to take a decision on the seized paddy of the petitioner which has been seized by the Krishi Upaj Mandi Samiti, but till date no decision has been taken by the respondent Nos.2 & 3 and
3 the petitioner is being deprived from the sale of the paddy. 3.
Learned counsel for the State/respondent would submit that if the petitioner’s representation is still pending before the respondent No.2-Collector, Mahasamund and respondent No.3-Sub-Divisional Officer (Revenue), the same will be considered and necessary decision & order will be passed in accordance with law within a period of twenty days from today. 4. I have heard learned counsel for both the parties. 5. In view of submission made by the learned counsel for the State, as the petitioner is seeking a limited prayer for decision of the pending representation before the respondent No.2-Collector, Mahasamund and respondent No.3-Sub-Divisional Officer (Revenue), Pithora, Dist:Mahasamund, C.G., it is directed that the respondent No.2-Collector, Mahasamund and respondent No.3- Sub-DivisionalOfficer (Revenue), Pithora, Dist:Mahasamund, C.G. shall take a decision on the application submitted by the petitioner as well as the communication made by the Krishi Upaj Mandi Samiti, Pithora dated 02/01/2025 to the SDO (Revenue) within a period of twenty days. 6. With the aforesaid observation, the writ petition is disposed of. SD/-
