Neutral Citation No. - 2025:AHC:59749 Court No. - 33 Case :- WRIT - C No. - 12007 of 2025 Petitioner :- Yunish Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Nigamendra Shukla Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J. 1. The petitioner has preferred the present petition inter alia with the prayer to direct the respondent nos. 2 and 3 to allot the fair price shop on compassionate ground under the dying-in- harness policy as per GO dated 05.08.2019 to the petitioner for Village Piperthara Jargavan, Gram Panchayat Jargavan, Block Jaitipur, Tehsil Tilhar, District Shahjahanpur. 2. Facts in brief as contained in the petition are that the father of the petitioner was having fair price shop license, he died on 28.10.2024. After his death the petitioner has moved an application dated 24.12.2024 before the respondent no. 3/Up Ziladhikari, Tilhar, Shahjahnapur for allotment of fair price shop license in his favour in terms of provisions as contained in the Government Order issued by the State Government dated 05.08.2019. 3. It is argued that considerable time has already been lapsed but till date no final decision has been taken in the matter. 4. From perusal of records it transpires that only a vague application has been submitted by the petitioner before respondent no. 3 hence the Court is of the opinion that no mandamus could be issued on the basis of papers filed alongwith petition. 5. At this point of time, a prayer has been made to permit the petitioner to submit all the relevant papers and documents for the grant of license in his favour on compassionate ground. 6. Heard learned counsel for the parties and perused the record. 7. In the facts and circumstances of the case, with the consent of parties the present petition is disposed of permitting the petitioner to submit a proper application as per the Government Order dated 05.08.2019 before the competent authority. In case, such application is filed the concerned authority will decided the aforesaid application expeditiously strictly in accordance with law and without granting unnecessary adjournment unless there is no legal impediment.
