The claim of the writ petitioner before the West Bengal Administrative Tribunal (in short ‘Tribunal’) was that she was in a living inrelationship with the deceased government employee since 2009. After severance of her earlier marriage on 07.04.2016 by virtue of an order passed in MAT Suit No.143 of 2012, she solemnized social marriage with the deceased government employee in the year 2016, whereafter the employee died while in harness. 2. The family pension sanctioning authority (the CMOH) has recognized the petitioner’s son as being one amongst the three legal heirs entitled
2 to share of all retiral dues to the extent of 1/3rd each. 3. The writ petitioner, however, has not been apportioned a share in the retiral dues of the employee who died in harness. The son and daughter of the deceased government employee from his first marriage, namely, Jeet Das and Doly Das, were made parties to the Original Application before the Tribunal, however, they have not been impleaded as parties in the present writ petition. The claim of the writ petitioner has a direct bearing on the dues being received by these two beneficiaries of the reasoned order dated 06.03.2019 issued by the CMOH, Purulia. 4. Considering these facts, the learned senior advocate appearing for the writ petitioner craves leave of this court to implead the son and daughter of the deceased employee from the first marriage, namely, Jeet Das and Doly Das, as respondents to the present writ petition. 5. The learned AGP has also drawn attention of this court towards the fact that these two persons were parties before the Tribunal. 6. In view thereof, we allow the prayer of the writ petitioner. Let him implead the above named
3 two legal heirs of the deceased employee in the writ petition here and now. Let notice be served on the newly added respondents by Speed Post and file affidavit of service on the next date of hearing. 7.
Let this matter appear under the same heading after ensuing Puja holidays on 4th November,
2025. In the meantime, the writ petitioner should also file supplementary affidavit annexing the complete Trial Court records. (Madhuresh Prasad, J.)
