The present petition has been filed by the petitioner with the following prayers: “10.1 That, this Hon’ble Court may kindly be pleased to quash/set-aside the FIR bearing Crime No. 29 of 2022 and Criminal Case No. 1244 of 2023 pending before Judicial Magistrate First Class, Raipur, District Raipur (C.G.). 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent Police authority to file a closure report in the FIR bearing Crime No. 29 of 2022. 10.3 Any other relief, which this Hon’ble Court may deem fit and proper, may also be passed in favour of the petitioner together with cost of the petition.” 3. On perusal of the prayer made in the present petition, it appears that the petitioner has prayed for quashing of the FIR as well as criminal case pending before the Court concerned and further the prayed for directing the respondent authorities to submit a closure report. 4. Learned State counsel submits that in the present case the closure report has already been submitted before the competent Court, to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with a liberty to file afresh petition with proper prayer. 5. Prayer is allowed. 6. In view of the above, the present petition is dismissed as 3 withdrawn with the aforesaid liberty, as prayed for. 7. Certified copy of the order-sheet as well as copy of the FIR may be returned back to the petitioner after retaining the photocopy of the same.
