1. The petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:-
“ this Hon’ble Court may kindly be pleased to issue appropriate direction to the respondent authorities to conduct free and fair enquiry as stipulated under Chhattisgarh Panchayat Nirvachan Niyam, 1995 with respect to deleting the name of the petitioner from the voter list of village Nawagaon Tikat, in the interest of justice. 10.2 this Hon’ble Court may kindly be pleased to hold that the petitioner is the bonafide resident of village Somnapur New and therefore, the inclusion of name of the petitioner in village Somnapur New is valid and legal. 10.3 Any other relief or relief(s) which this Hon’ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted.”
2. Learned counsel for the petitioner submits that the petitioner has submitted an application before the Collector dated 10/12/2024 (Annexure P-1) alleging that the respondent No.4/Registration Officer, Pandariya is pressurizing to delete his name from the
3 voter list of village Somnapur New, Tahsil Pandriya, District: Kabirdham, C.G. He further submits that the petitioner is residing in the village Somnapur New and her name was added in the voter list of said village on 10/12/2010, therefore, he prays that the petition may be disposed of directing the Collector, District: Kabirdham, C.G. to decide the said application filed by the petitioner, expeditiously.
3. Learned counsel for the State has no objection to allow the limited prayer made by the petitioner and submits that if such application is still pending, the same shall be decided in accordance with law.
4. Having considered the limited prayer made by the petitioner, which is not opposed by the State counsel, this petition is
disposed of and it is directed that if such application is still pending, the same shall be decided by the Collector, District: Kabirdham, C.G. in accordance with law within a period of 30 days from today.
5. With the aforesaid observation(s) and direction(s), this petition stands disposed of.
6. The pending interlocutory application(s), if any, also stands
