Neutral Citation No. - 2025:AHC:61475 Court No. - 4 Case :- WRIT - A No. - 5176 of 2025 Petitioner :- Ravindra Kumar Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Yogesh Kumar Mishra Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the notice dated 10.03.2025 by which he has been asked to vacate the official accommodation by 07.04.2025. Learned Standing Counsel submits that petitioner has no right to retain the official accommodation once he has been transferred from Hapur to Moradabad where he has joined. He further submits that petitioner has already represented the matter before the competent authority namely the respondent no. 4 on 11.04.2024 which may be directed to be disposed of in accordance with law. In view of the above, while I decline to interfere with the notice dated 10.03.2025, I direct the respondent no. 4 to look into and consider the representation made by the petitioner against the notice to vacate the official accommodation and dispose of the same by means of reasoned and speaking order within a period of one month from the date of receipt of certified copy of this order. It is however, clarified that the Court has not adjudicated upon the merits of the claim of the petitioner. Petition is accordingly consigned to records.
