The petitioner has been issued charge memo, vide G.O.Rt. No.191, Revenue (Vigilance-ll) Department, dated 30.03.2021, for the incident occurred on 04.12.2015, alleging that while working as in charge Sub-Registrar, SRO, Kothapeta, since 02.12.2015, on 04.12.2015, after completion of the review meeting held by the District Registrar Sri V.Ranga Reddy at his office at Rajamahendravaram, he paid monthly mamool of Rs.2,000/- to Sri V.Ranga Reddy in his office, to overlook administrative lapses committed by him and thus, has exhibited lack of integrity, devotion to duty and conduct un-becoming of a Government Servant and thereby contravened Rule 3(1) & (2) of A.R Civil Service (Conduct) Rules, 1964. Pursuant to charge memo, the petitioner submitted explanation on 21.06.2021 refuting the said allegations. Though, nearly five years have lapsed, the departmental enquiry is not yet commenced and the petitioner is stated to be eligible and qualified for promotion to the post of Sub-Registrar Grade-ll. However, in view of pendency of disciplinary proceedings, his case is not being considered. 3. Heard Sri K.R. Srinivas, learned counsel for the petitioner and learned Assistant Government Pleader for Services-I for respondents. 4. Admittedly, charge memo came to be issued vide G.O.Rt.No.191 Revenue (Vigilance-ll) Department, dated 30.03.2021, for the incident 3 CGR, J, W.P.No. 12361 of 2025 occurred on 04.12.2015. Though nearly five years have lapsed, the aforesaid departmental proceedings are not yet concluded and petitioner is stated to be eligible and qualified for promotion to the post of Sub-Registrar Grade-ll and mere pendency of aforesaid proceedings could not prejudice petitioner's prospects for promotion. Learned counsel for the petitioner relies on the order of the Division Bench of High Court of Judicature, Andhra Pradesh at Hyderabad, in Government of A.P. v. A.Rajeswara Reddy\ wherein the Court dealt with a similar case and held that according to G.O.Ms.No.679 dated 01.11.2008, the departmental proceedings have to be completed within 6 months, in complicated cases and 3 months in simple cases, promotions of the candidates cannot be deferred on the ground that in cases where departmental proceedings are pending beyond that period. 5. 6. Hence, in view of the above, the present Writ Petition is disposed of at the admission stage, directing the respondents to consider the of the petitioner for promotion without reference to the charge pending against him. It is, however, made clear that the promotion would be subject to the result of the inquiry. The respondents are also directed case memo 2010 (4) ALT 374 (D.B.) 4 CGR, J. W.RNo.12361 of 2025 to complete the inquiry as expeditiously as possible, preferably within a period of six (06) months from today. There shall be no order as to costs.
