This is the first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 185/2024 registered at Police Station- Shankargarh, District Balrampur-Ramanujganj (C.G.), for the offence punishable under Section 109, 3(5) of BNS. 2. Learned State counsel has pointed out that though the FIR was 2 registered under Section 109 and Section 3(5) of the BNS, but after the investigation, the offence has been converted under Section 103(1) of the BNS as the injured has died, but the bail application has not been filed by the applicant for offence under Section 103(1) of the BNS before the trial Court and filed the same only for offence under Section 109 and Section 3(5) of the BNS. 3. In view of above, the present bail application is dismissed as withdrawn with liberty to the applicant to move an appropriate application before the Court concerned for the offence in question. - Sd/- (Ramesh Sinha) Chief Justice Kunal
