1. The petitioners in the instant contempt petition have alleged non- compliance of order dated 06.05.2024 passed in WPC No. 1603/2021 wherein upon disposal of the said writ petition, the respondents came to be directed to consider the claim of the petitioners regarding payment of gratuity in the light of the ratio laid down by the Supreme Court in case reported in AIR 2022 Supreme Court 2119, provided the principles of the same apply to the case of the petitioners.

Compliance report has been filed by the respondents/contemnors 1 and 2 to the contempt petition wherein, it is being inter-alia stated that in compliance to the orders passed by this court, the case of the petitioners was considered and rejected vide order no. Pros/D/WPC- 1603-2021/2025/10306-08 dated 28.02.2025. Heard and perused the record.
3. Having regard to the order passed by the writ court non-compliance of which has been alleged inasmuch as, the compliance report filed by Serial No. 5
2 CCP (S) No. 330/2024 in WP (C) No. 1603/2021
the respondents/contemnors including the consideration order dated 28.02.2025, seemingly respondents/contemnors have complied with the order, thus, requiring the recalling of the contempt notice and closure of the contempt proceedings. Ordered accordingly.
4. The petitioners, however, shall at liberty to work out the remedy against the consideration order, in case of the availability of the cause and if so advised.
