ORDER: This Criminal Petition, under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short lBNNS') is filed by petitioner/A3, seeking regular ba'll in Crime No.258 of 2024 of GRP police station, vllsakhapatnam D'lstr'lct registered for the OffenceS punishable under section 20 (b)(ii)(C) r/w 8(c) of NDPS Act,1985.
2. Heard Ms. Kolli Ushakiranmayee, leamed COunSel for petitioner/A3 and the learned Assistant Publ'lc Prosecutor for respondent/State. \
3. Perused the record.
4. Having heard the learned counsel On both Sides and Perused the record, it -ls seen that on o6.08.2024, the ra'lding party arrested Al and recovered 23.5 kgs of ganja, and he Was remanded tO judicial Custody. on 31.08.2024, A2 was arrested and remanded tO jud'ICial Custody. By
order dated o7.ll.2024 in Crl.P.No.7441 of 2024, this Court granted regular bail to A2 on the prem-lSe that nO Part Of the contraband Was recovered from him. The investigation further Progressed. On 21.ll.2024 at the Railway Station platform, A3 was arrested and remanded to judicial custody. By the present Petition, A3 seeks regul?+:+ +
^ bail. The learned Assistant Public Prosecutor has opposed the bail application. 5. A review of the remand report shows that no part of contraband was recovered from the possession of the petitioner. According to the prosecution, the petitioner is alleged to have procured the ganja and sold it to A1. The version is based on the alleged confession of the present petitioner and co-accused. However, despite more than two months having passed, the investigating agency has failed to produce any further material evidence indicating the petitioner's complicity. ln these circumstances, any further continuation of detention does not seem necessary. Hence, this Court finds that petitioner/A3 shall be enlarged on bail. 6. In view of the said circumstances, the Criminal Petition is allowed. Petitioner herein/A3 shall be enlarged on bail on executing a personal bond for a sum of Rs.30,000/- (Rupees Thirty Thousand only) with two sureties of the like sum each to the satisfaction of the learned Special Sessions Judge for trial of the cases under the Narcotic Drugs and Psychotropic Substances Act, 1985-Gum-I Additional Sessions Judge, Visakhapatnam. The petitioner is permitted to furnish the sureties from the State of Andhra Pradesh. Petitioner/A3 shall mark his attendance before the Investigating officer on lSt and 15th of every month between 10.00 A.M. and 1.00 P.M. till filing of the charge sheet. Petitioner/A3 shall make himself available for investigation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the case so as to dissuade them from disclosing such facts to the_,gr
To, r/ Court or to any police officer. He shall not indulge in similar acts of crime and shall duly attend the trial of the case. The petitioner shall regularly appear before the competent court and participate in pre-trial and trial process without fail. Pending miscellaneous applications, if any, shall stand closed.
