Ms. Mayuri Lakhanpal Kalia, DAG, Haryana. *** SANDEEP MOUDGIL, J (ORAL) This petition has been filed under Section 483 of BNSS for grant of regular bail in FIR No. 140 dated 17.04.2021 under Section 302 IPC, P.S. Madhuban, District Karnal. Status report by way of affidavit of Geeta Bharti, IAS, Secretary to Govt. Haryana Home Department has been filed on behalf of State Counsel, the same is taken on record. Copy of the same has been furnished to the counsel opposite. A perusal of the affidavit depict that out of 15 PWs, 11 PWs have been examined after framing of charges on 22.09.2021 whereas on the last date of hearing 25.04.2025, the pervi report was not correct which stated Anuradha 2025.05.15 07:03 I attest to the accuracy and integrity of this document CRM-M-20716-2025 2 that after framing of charges on 20.08.2021, no witness has been examined and trial has not commenced and it was under that information provided to this Court, the affidavit of officer concerned was called for. In light of the clarity of the stage of the trial which is satisfactory as out of 15 PWs, 11 PWs have been examined and remaining has been summoned for 16.05.2025, no further interference is called for as far as the issue of delay in trial is concerned. Coming to the merits of the instant case, the Court is of the view that the trial is actually going at a good speed as larger number of witnesses have been examined and remaining witnesses have been summoned for 16.05.2025. Faced with this situation, learned counsel for the petitioner prays for withdrawal of the instant case at this stage. Allowed as prayed for. Dismissed as withdrawn at this stage.
