Adv, Mr. Tapas Ballav Mondal. ... for the State. Pursuant to the earlier direction passed on 18.11.2024, police authorities conducted further investigation after consultation with the B.D.O. Rotua-II, Block. The petitioner namely, Amiruddin along with other Panchayat Samiti members represented to the police authorities that no incident of ransacking of government properties occurred at the Office of Sabhapati of Ratua-II Block Office. The written complaint which was submitted also did not contain any issue relating to ransacking reported by the petitioner. Petitioner apprehends that he may be subjected to harassment in case incidents are reported to the police station. The Officer-in-Charge, Pukhuria Police Station will consider the representation in the background that the petitioner earlier had to face inconveniences and was threatened at the behest of the others. To that effect if required the Officer-in-Charge will seek permission from the jurisdictional Court in-charge of Pukhuria Police Station case no. 269/2023, the concerned Magistrate in seisin of the case would consider the threat perception 2 and thereafter pass necessary orders under the Witness Protection Scheme, 2018. With the aforesaid observations WPA 26985 of 2024 is disposed of. Report so submitted by the State be kept with the record. A copy of the report be handed over to learned advocate appearing for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
