Heard Mr. Soumitra Kesharwani, learned counsel for the petitioner. Also heard Mr. Hariom Rai, learned Panel lawyer for the State/respondent No. 1 as well as Mr. Rahul Mishra, learned counsel for the respondent No. 2. 2. By this petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023, the petitioners have prayed for the following relief(s): “10.1 To quash the FIR No. 0031/2024 registered at P.S. Mahila Thana, Ambikapur (Surguja) dated 02.10.2024 for offence under Section 498A of the Indian Penal Code, 1860 against the Petitioners. 10.2 To kindly make any other order that may be deemed fit and just in the facts and circumstances of the case including 3 awarding of the cost to the petitioner.” 3. At the outset, learned counsel for the petitioners submit as the charge sheet has already been filed by the Police before the competent Court, he may be permitted to withdraw this petition with liberty to challenge the same. 4. Learned counsel for the respondents have no objection. 5. In view of the above, this petition is dismissed as withdrawn reserving liberty to the petitioners to take recourse to law, if so advised. 6. Certified copy of annexures may be returned back to the petitioners after retaining photocopy of the same.
