The challenge in this petition is made to the order dated 18.02.2025 passed by the respondent no.1/Mussoorie-Dehradun Development Authority (“MDDA”), by which a plan for construction of house has been rejected on the ground of pendency of Writ Petition (M/S) No. 1647 of 2008, Chandrapal Singh and others Vs. Chief Revenue Commissioner, Uttarakhand and others. Heard. Learned counsel for the petitioner would submit that this may not be a ground to deny permission to the petitioner. He would submit that this matter is covered by the judgment dated 21.10.2024, passed in WPMS No. 1630 of 2023, Ranjan Negi Vs. Mussoorie Dehradun Development Authority and others. Learned counsel for the respondent no.1 would submit that if the petitioner makes a representation, it shall be considered within a period of four weeks. The writ petition is disposed of with a liberty to the petitioner to make a fresh representation before the respondent no.1 with further direction to the respondent no.1 to decide the representation of the petitioner within a period of four weeks in accordance with law.
