1. Heard Shri Rohitshva Singh, learned counsel for the petitioner and Shri Khulesh Sahu, learned Panel Lawyer for the State. 2. Instant petition has been filed seeking following reliefs:-
“(i)That this Hon'ble Court may kindly be pleased to call for relevant records from Respondents in respect of petitioner case. (ii)That this Hon'ble Court may kindly be pleased to issue an appropriate writ/ order or direction for quashing the order dt. 10.10.2024 and subsequent order dated 26.11.2024 passed by the Commissioner Surguja Division Ambikapur District Surguja (C.G.) regarding petitioner's posting in the office of Women and Child Development officer Jashpur District Jashpur (C.G.) and also kindly be pleased to direct respondent authority to give posting to petitioner in his original posting place i.e. office of Integrated Child Development Scheme Manora District Jashpur (C.G.). (iii)That this Hon'ble Court may kindly be pleased to direct respondent authority to consider petitioner’s suspension period as working period and provide salary for that period. (iv)That this Hon'ble Court may kindly be pleased to grant any other ancillary relief deems fit in the facts and circumstances of the case.”

Learned counsel for the petitioner submits that the petitioner was suspended while he was posted as Assistant Grade-I in the office of Project Officer Integrated Child Development Scheme, Manora and thereafter on suspension, he was attached to the Head Office, Jashpur,
3 thereafter his suspension was revoked and he was posted as Assistant Grade-I in the office of Project Officer Integrated Child Development Scheme Dokada, there was no post available for Assistant Grade-I in the office of Project Officer Integrated Child Development Scheme Dokada, therefore the petitioner has moved an application and on the basis of that application he was again posted in the office of Project Officer Women and Child Development Officer, Jashpur, however according to the petitioner in that office also post of Assistant Grade-I is not available and as such the petitioner is wandering here and there for getting his posting order after revocation of suspension. 4. Learned State counsel submits that since departmental enquiry has already been initiated against the petitioner, as such there is no need to pass any order. 5. The petitioner is fairly submitting that the petitioner should be posted to a place where post of Assistant Grade-I is available. Accordingly, the respondents are directed to pass appropriate orders in respect of the posting of the petitioner within a period of one month, however it is made clear that the respondents shall not take any coercive steps against the petitioner as the petitioner is approaching right from the beginning for his posting after revocation of suspension. 6.
