UPENDRA RAO MANUKONDA The Court made the following: JUDGMENT: (per Hon’ble Sri Justice Ravi Nath Tilhari) This appeal was filed by the plaintiffs, being aggrieved by the interlocutory order dated 14.02.2024 in I.A.No.1296 of 2023 pending O.S.No.157 of 2023 on the file of III Additional District Court, Guntur. The plaintiffs’ application was rejected. 2 2. Learned counsel for the appellants submits that the parties have settled their dispute and an application for compromise has been filed in the suit. A memo to that effect has also been filed. 3. The said memo is being reproduced as under:- <MEMO” “It is submitted that in view of the compromise recorded before the trial court in O.S.no.157 of 2023 on the file of III-Addl. District Court, Guntur between, the appellants (plaintiffs) and respondents 1, 2, 5 and 6 (defendants 1,2, 5 & 6) under which an amount of Rs.1,09,00,000/- (one Crore Nine Lakhs only) was paid by the above respondents towards the suit claim to the appellants, they may be permitted to withdraw the above CMA.No.635 of 2025 in the interest of justice. Hence, the memo=. 4. As there is no objection for dismissal of the appeal as withdrawn, recording the aforesaid, this appeal is dismissed as withdrawn. No order as to costs.
