Order:
This Civil Revision Petition is filed aggrieved by the order, dated 23.12.2024 in I.A.No.574 of 2024 in O.S.No.412 of 2021 on the file of the learned Principal Civil Judge (Junior Division), Nellore, SPSR Nellore District, whereby the Court below allowed the petition filed under Order XV-A CPC by the respondent/ plaintiff, seeking a direction to the petitioner/ defendant to pay arrears of rents to a tune of Rs.5,32,000/-.

The respondent/plaintiff filed the suit in O.S.No.412 of 2021 before the Court below, seeking a direction to petitioner/ defendant to vacate and deliver vacant possession of the plaint schedule property to her. It is her case that the petitioner/ defendant committed default in payment of monthly rents in respect of the plaint schedule property and an amount of Rs.5,32,000/- is due from 01.07.2018 onwards. Pending disposal of the suit, the respondent/plaintiff filed the aforesaid I.A.No.574 of 2024 seeking direction to the petitioner/defendant to pay arrears of rent and the said petition was allowed vide impugned
Order.

Learned counsel for the petitioner submits that 50% of the arrears of the rent has been deposited, and since the remaining amount has not been deposited, petition under Order XV-A of CPC has been filed before the learned Principal Civil Judge (Junior Division), Nellore, which was allowed vide impugned
Order, dated 23.12.2024 with the following direction:
“(v) Therefore, this Court is inclined to allow the petition directing the respondent/defendant to pay/deposit the arrears of rent of Rs.5,32,000/- for the period from 01.07.2018 to 30.10.2024 @ Rs.7,000/- per month, within a period of two months, failing which the defence will be struck off. Further, the said amount deposited will be adjusted for the subsequent rents of the said property subject to the result of the main suit.”

Learned counsel for the petitioner undertakes that the petitioner/defendant is ready to deposit the balance of the arrears amount.

Having regard to the submission of the learned counsel for petitioner/defendant, the petitioner/defendant is permitted to deposit balance 50% of the amount within a period of eight (8) weeks from the date of receipt of copy of this order. On such deposit, respondent/plaintiff is permitted to withdraw the same.

7. With the above direction, CRP is disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed.
