And 3 Others Counsel for Petitioner :- Ashwani Kumar Mishra,Vipin Kumar Singh Counsel for Respondent :- C.S.C.,Nagendra Nath Mishra Hon'ble Ajay Bhanot,J. The petitioner claims that he is the nominee of the deceased employee and is entitled to various terminal benefits of the deceased employee. He has made a representation before the competent authority but to no avail. The only prayer made by Shri Nityanand Mishra, learned counsel holding brief of Shri Ashwani Kumar Mishra,
learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Ashutosh Kumar Pandey, learned counsel holding brief of Shri Nagendra Nath Mishra, learned counsel for the respondent submits that the matter requires determination of facts by the competent authority as per law in the first instance. However, he fairly contends that service benefit/claim is liable to be decided by the competent authority in a reasonable time frame.
In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 3 is
directed to decide the claim of the petitioner strictly in accordance with law after verifying his credentials and noticing all other legal heirs of the deceased employee as per law within a period of six months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
