1. Heard Mr. Shailendra Shukla, learned counsel appearing on behalf of the petitioner as well as Mr. Shashank Thakur, learned Deputy Advocate General appearing on behalf of the State. 2. The present writ petition has been filed by the petitioners with the following prayers:
“i. That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to remove the encroachment made by the private respondent and allow the villagers of Village
3 Bakulahi to use the land in question for the purpose for which it was reserved. ii.
That, this Hon'ble Court may kindly be pleased to cancel the illegal allotment of land including diversion of land in favour of Respondent No.7 which is a community land which is reserved for the purpose of use of the villagers, without which the villagers cannot live in the village, in the interest of justice. iii. Cost of the petition may kindly be granted to the petitioner. iv. Any other relief, which this Hon'ble Court deems fit and proper, may also kindly be granted, in the interest of justice. v. An affidavit in support of this petition is being filed herewith.”

From perusal of the memo of the writ petition, it reflects that the petitioner has filed an application to grant exemption from security deposit for pursuing the matter as 'Public Interest Litigation'. 4. After hearing the learned counsel for the petitioner and going by the nature of contents raised and such other relevant facts disclosed from the pleadings, we are not inclined to allow the prayer in the said application. 5. At this stage, learned counsel for the petitioner seeks to withdraw this PIL with a liberty to file after after effecting the statutory deposit in accordance with the relevant rules. 4
6. Prayer appears to be fair and reasonable. 7. Accordingly, instant PIL is dismissed as withdrawn with aforesaid liberty granted in favour of the petitioner. Sd/- Sd/- (Ravindra Kumar Agrawal)
