That, this Hon'ble Court may kindly be pleased to call for entire records regarding present case from Courts below. 10.2. That this Hon'ble Court may kindly be pleased to set- aside the order dated 07.12.2024 passed by the Learned Principal District Judge Bemetara (C.G.) in Execution Case No. 2-A/2024, Between "Nanabai Vs. Bhagwati & others" (Annexure P/1), is in the interest of justice. 10.3. That, any other relief/order which may deem fit and just, in the facts and circumstances of the case including award of the costs of the petition may be given.” 2) Mr. Ratnesh Kumar Agrawal, learned counsel appearing for the petitioner would submit that the suit was filed by respondent No.1 for declaration of title and permanent injunction pertaining to the property mentioned in Schedule – A and B, situated at Village Chetuwa, Tehsil Bemetara, Distt. Durg. The suit (7A/2013) filed by the plaintiff was decreed on 23.07.2016. Thereafter, respondent No.1 moved an application for execution of the decree. He would submit that since the decree was declaratory in nature, it was not executable, and the learned Executing Court committed an error of law in entertaining the said application. 3) On the other hand, Mr. Kunal Das, counsel appearing for the respondent No.1 opposed the submission made by counsel for the petitioner and submit that the possession of the petitioner has been secured by the learned Civil Court, and in order to retain the possession of the property, an execution application was moved. He submits that the learned Executing Court rightly took cognizance, -3- and the petition filed by the petitioner deserves to be dismissed. 4) The Civil Suit No. 7A/2013 culminated in the following decree:- “1) यह घोषित षिय जा त ह षि वा दिनी नीनी बा ई ग्रा म चेटुवा , तह०- बारला , जिजाला - बामतर म वा पत्र सा थ सा"लाग्नी अनीसा%चे "अ" नीक्शा म वार्णि()त वा ग्रास्त आबा , भू%निंनी) एवा" उसा पर बानी म नी एवा" अनीसा%चे "बा" म उल्लाखि3त षिवावा दित भू%मिम ला 5त 3सार नी"बार 21 ला रबा 8.50 एड़ (3.447 हक्टु.) भू%मिम 5 स्वा मिमनी ह। (2) उपरक्त वार्णि()त वा ग्रास्त भू%मिम म वा दिनी आमि9पत्य म 3ला नी सा प्रषितवा , क्रम " 1 सा 3 स्था य षिनी9 ज्ञा द्वा र षिनीमि9त षिय जा त ह। (3) यह घोषित षिय जा त ह षि प्रम (र( आश म ध्यम सा षिय गय नी म न्तर( क्रम " 70 वाD 1977 अवा9 ह। (4) वा पत्र सा थ सा"लाग्नी अनीसा%चे "अ" एवा" "बा" आज्ञाप्तिFत अ"ग हग । (5) उभूयपक्ष अपनी - अपनी वा व्यय वाहनी रग।” 5) A bare perusal of the decree makes it evident that any part of the decree is not executable, as it merely declares title and grants permanent injunction. 6) Taking into consideration the fact that the learned Executing Court travelled beyond the judgment and decree passed by the learned Civil Court, the cognizance taken by the learned Executing Court on the application moved by the decree-holder for execution is erroneous. 7) Accordingly, the proceedings initiated by the Executing Court dated 07.12.2024, -4- by the Learned Principal District Judge Bemetara (C.G.) in Execution Case No. 2- A/2024, between "Nanabai Vs. Bhagwati & others" (Annexure P/1) are hereby set aside. This petition is accordingly allowed. 8) Interim relief, if any, granted earlier stands vacated. Sd/- (Rakesh Mohan Pandey) Judge Nadim
