2. The present application has been preferred: for issuance of a writ in the nature of Mandamus and/or any other appropriate
order or direction commanding upon the respondents to restrain the respondents to
Patna High Court CWJC No.10478 of 2025(3) dt.30-03-2026 2/3 construct Panchayat Sarkar Bhawan over Khata no. 366, Khesra no. 115, area 7 Katha 10 dhur land and 3 Katha 15 dhur respectively which is purchased by the petitioners' father by registered Sale-deed. And further for issuance of appropriate writ,
order or direction for quashing the letter no. 5789 dated 01.12.2023, issued by the Collector, Samastipur arbitrarily and illegally.
3. The petitioners claim that they purchased 11 kathas 25 dhurs of land through two sale deeds from Kushi Chaudhary under Bithan Circle in the district of Samastipur (Khata No. 366, Khesra- 115).
4. Subsequently, the mutation was also allowed and the rent receipt of the year 2013 has been provided to support the case. The grievance is that on the said land, Panchayat Sarkar Bhawan is being constructed by the respondents.
5. Learned State Counsel submits that the chain is incomplete inasmuch as neither the title of the vendor has been provided nor there is anything to show why it took 21 years to get the first rent receipt as the claim is that the purchase took place in the year 1990.
6. At this stage, learned counsel for the petitioner submits that he shall be satisfying the Collector of the district
Patna High Court CWJC No.10478 of 2025(3) dt.30-03-2026 3/3 along with all the relevant documents to support the case.
7. Learned State Counsel has no objection.
8. In that background, the writ petition is disposed of allowing the petitioner to agitate the grievance before the respondent no. 2, the Collector, Samastipur in next eight weeks and if such petition is filed, after noticing the parties and hearing them, be taken to its logical conclusion at an earliest.
9. The writ petition is disposed of with aforesaid observation.
10. Needless to add, any development that may take place in between will be subject to the final outcome of the
order passed by the Collector, Samastipur.
