1. The short grievance projected by the petitioner in the instant petition is that an ex-parte order passed by the Assistant Labour Commissioner in his favour and against respondents 4 to 7 for making payment of Rs. 16,93,471/- along with interest, was not complied with by the said respondents 4 to 7, necessitating the filing of appropriate proceedings by the petitioner herein before the Assistant Labour Commissioner, Samba, who initiated recovery proceedings thereof in this regard through Tehsildar, Samba which recovery proceedings are pending before Tehsildar, Samba being respondent 3 herein having not made any progress thereof compelling the petitioner to maintain the instant petition for seeking direction against respondent 3 herein to conclude the said proceedings filed by the petitioner without any further delay.
2. Objections to the petition have been filed by respondents 1 and 4 to 7, wherein it is being stated that the petitioner was working with the answering respondents as a Senior Boiler incharge and retired from services on 3.10.2020 and that on account of poor financial position of Serial No. 42

the answering respondents, the amount payable to the petitioner could not be paid pursuant to the order of the Assistant Labour Commissioner, while stating further that the answering respondents have appeared before Tehsildar, Samba-respondent 3 herein and have submitted before Tehsildar, Samba-respondent 3 that efforts are being made for payment of the amount due to the petitioner by the answering respondents.
3. Having regard to respective pleadings of the parties inasmuch as grievance projected by the petitioner in the instant petition, the same is
disposed of with consent of the appearing counsels for the parties at this stage with a direction to respondent 3 herein to conclude and determine the proceedings pending before him pertaining to the case of the petitioner in accordance with law without any delay, preferably within a period of eight weeks from the date copy of this order is produced by the petitioner before respondent 3 herein.

Disposed of.
