GP FOR REVENUE DR,J W.P.NO.33445 of 2025 The Court made the following ORDER: This Writ Petition is filed assailing the inaction of the respondents for non consideration of the representation of the petitioner dated 10.10.2025 seeking to provide alternate land in lieu of encroaching on the petitioners land to an extent of 15 Cents situated at Survey number 601/3, (old No. 571) at Srikurmam Village, Gara Mandal, Srikakulam District. 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents. 3. Learned counsel for petitioner submits that in fact, the competent civil court i.e., Principal Junior Civil Judge, Srikakulam has considered the suit filed by the petitioner as against the revenue officers and the Grama Panchayat and granted injunction in favour of the petitioner. 4. As against that, the respondents have preferred CMA.No.19 of 2019 before learned Principal District Judge, Srikakulam. The learned Judge in an elaborate order directed the respondents to get the survey of land and demarcate the site donated to the Government by the petitioner and his family members i.e., Ac.5.00 cents and further directed the respondents not to proceed with the construction, if the proposed construction is within Ac.0.15 cents of the land of the petitioner i.e., beyond Ac.5.00 cents already donated to the Government. DR,J W.P.NO.33445 of 2025 5. Based on the above said directions, the petitioners has made a request for grant of alternate site by a representation dated 10.10.2025. The same is not being considered. 6. Considering the submissions made by the learned counsel for petitioner as well as perusal of the orders in I.A.No.206 of 2015 in O.S.No.60 of 2015 and CMA.No.19 of 2019, the respondents are directed to consider the representation of the petitioner and pass appropriate orders based on the survey within a period of two months from the date of receipt of a copy of this order. 7. Accordingly, the writ petition is disposed of. No costs.
