HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 12/11/2025 Vide order dated 11.09.2025, the instant bail application was allowed and the petitioner was directed to be released on bail. Taking note of the fact that though the offences, alleged to have been committed in the present FIR are bailable in nature, as to why the accused petitioner was denied bail by learned District and Sessions Judge, Kotputli-Behror and judicial remand of the accused petitioner was extended by concerned Judicial Magistrate, explanation was sought from them. In compliance of above directions, letters-cum-explanations dated 10.11.2025 have been sent by both the officers. Same are taken on record. I have perused the same. Both officers tried to give reasons for the said mistake/lapse on their part. Both the officers,
[2025:RJ-JP:45616] (2 of 2) [CRLMB-10375/2025] however, expressed sincere apology and regret for the inadvertent mistake. Though, this Court is not fully convinced with the explanations, but looking to the heavy work load and lack of quality assistance provided by prosecution side as well as accused petitioner’s side before the concerned judicial officers, this Court does not wish to pass any comment/remark on such lapse/mistake. Thus, the explanations are accepted with advice to both the judicial officers to remain more careful and cautious in future while discharging judicial work. The file stands closed.
