By the instant writ petition, the petitioner is seeking quashment of impugned order dated 11.11.2024 (Annexure P-12) passed by the SDO, (R) Berla in which interim relief has been granted in favour of respondent No. 1. The said appeal is still pending before the SDO ( R). 2. Learned State counsel submits that the order of interim relief passed by the SDO is under challenge before this court which is not maintainable as the appeal is still pending before the SDO. 3. I have heard learned counsel for the parties and perused the orders impugned. 4. Perusal of the order under challenge dated 11.11.2024 (Annexure P- 12) shows that by the interim order in favour of Respondent No. 1, i.e. the appointment of petitioner as Kotwar vide order dated 06.11.2024 has been stayed and the appeal is still pending before the SDO. 5. Considering the facts and circumstances of the case, SDO ( R) Berla is directed to decide the appeal within 40 days from the receipt of the copy of this order. 6.
