The Court made the following Order:
Heard the learned counsel for the petitioners, the learned Assistant Government Pleader for the respondent Nos.1 to 4 and the learned Standing Counsel for the 5th respondent. 2. This writ petition was filed questioning the action of the respondents in trying to assign the house site pattas under the Navaratnalu-Pedalandariki Illu program in the land in R.S.No.52/1 and 52/3 of Thumula Cheruvu, Hamlet of Kona Village, Machilipatnam, Krishna District, which was classified as Puntha without following the due process of law. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 5th respondent submits that the alternative land was proposed for the above said housing scheme and the subject land is not utilized for the above said purpose. 4. In view of the same, as the subject land is not utilized for the above said public purpose, no further orders are necessary in this writ petition. However, the respondent Nos.2 to 5 are directed to deal with the subject land in R.S.No.52/1 and 52/3 of Thumula Cheruvu, Hamlet of Kona Village, Machilipatnam, Krishna District, strictly in accordance with law, if so warranted for any public purpose.
5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs. 4 HBKM,J W.P.No.7347 of 2020
