THIS CRIMINAL PETITION IS FILED UNDER SECTION 482 CR.PC (FILED U/S 528 BNNS) PRAYING TO QUASH THE PROCEEDINGS IN PCR.NO.15171/2024 ON THE FILE OF THE LEARNED XLI ADDITIONAL CHIEF JUDICIAL MAGISTRATE, BANGALORE AND ETC. THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER In this petition the petitioners seek the following reliefs:
“a. Quash the PCR filed by the respondent No.2 in PCR No.15171/2024 dated 12.12.2024 in respect of the offence punishable under Section 318(4), 352, 351(3) and 3(5) of the BNS Act, 2023 against the petitioners herein before XLI Additional Chief Judicial Magistrate, Bangalore, and order dated 12.12.2024 taking of Cognizance by the XLI Additional Chief Judicial Magistrate, Bangalore and the FIR registered by the respondent Police in Crime No.649/2024 dated 17.12.2024 upon receiving the order of the Trial Court (Annexure-A, B and C).

b. Grant such further and other reliefs as are just.”
2. Heard learned counsel for the petitioners, learned HCGP for respondent No.1 and learned counsel for respondent No.2 and perused the material on record.
3. The petitioners as well as respondent No.2 – complainant have entered into Memorandum of Settlement dated 04.02.2025, in which they have amicably settled the dispute among themselves. In pursuance of the same, the petitioners have handed over two demand drafts bearing Nos.411560 and 411512, dated 21.02.2025 and 31.01.2025, respectively and respondent No.2 as well as his counsel have acknowledged the receipt of the said demand drafts.
4. In view of the settlement arrived at between the petitioners and respondent No.2, the impugned proceedings in PCR No.15171/2024 (Crime No.649/2024 registered by respondent No.1-Police) pending on the file of the XLI Additional Chief Judicial Magistrate, Bengaluru, are hereby quashed, subject to the petitioners complying with the remaining terms of compromise arrived at between the parties. It is made clear that if the

petitioners do not comply with the remaining terms, the present
order would stand automatically recalled and the present petition would stand revived, without reference to Bench.
5. Subject to the aforesaid observations and directions, the petition stands disposed of.
