CRL.M.A. 6883/2025 (for modification of order dated 10.02.2025)
1. Vide order dated 10.02.2025 of the predecessor bench, the petitioner was directed to be released on parole subject to certain conditions mentioned in the order including his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent. Now through this application, the petitioner seeks exemption from producing a surety and instead, for accepting cash surety. Vide order dated 04.03.2025, the predecessor bench had directed the respondent to file status report disclosing the details of surety, if any furnished by the petitioner while availing parole earlier. 2. Accordingly, status report dated 18.03.2025 was filed but thereafter, the matter never reached even beyond 05:00 pm on three dates. Today also, it is 05:05pm. This is a digitally signed order. 3. In status report dated 18.03.2025, it is disclosed by the respondent that earlier the petitioner was released on parole subject to furnishing cash surety along with personal bond. Admittedly, after concluding the parole term, the petitioner did return to the jail. 4. Considering the above circumstances, the application is allowed and in lieu of producing a surety in the sum of Rs.10,000/-, the petitioner is allowed to deposit cash surety of the same amount and also furnish personal bond in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent and to that extent, order dated 10.02.2025 of the predecessor bench stands modified. Further, the petitioner being a resident of Unnao, U.P., condition no.(iii) of order dated 10.02.2025 of the predecessor bench stands recalled. Rest of the conditions mentioned in order dated 10.02.2025 shall stand as it is. GIRISH KATHPALIA, J MAY 9, 2025/ry
