1. The applicant has preferred this First bail application under Section 483 of BNSS for grant of regular bail as he is arrested in connection with Crime No.451/2016, registered at Police Station –
2 Durg, District Durg (C.G.) for the offence punishable under Sections 420, 409, 120B/34 of IPC and Sections 3, 4 of Prize Chits and Money Circulation Scheme Banning Act, 1978.

As per the prosecution story, it is alleged that the present applicant along with other co-accused persons collected huge amount from different persons including the complainant alluring them to return the amount with high rate of interest. After collection of huge amount, the office of the Company was closed and thereby, they cheated the depositors. Based on this, offence has been registered and the applicant has been taken into custody on 11.08.2016.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. He further submits that the applicant approached Hon’ble Supreme Court in respect of FIR registered in Raipur, Hon’ble Supreme Court observed that as the charge sheet has been filed and applicant is in custody for more than 8 years and, therefore applicant is entitled for release forthwith, subject to the terms and conditions to be imposed by the Court of Chief Judicial Magistrate, Raipur. He again submits that vide order dated 26.08.2022, similarly situated co-accused person namely Rakesh Tomar, who was also Director in the said company has already been granted bail in MCRC No. 6216/2022 by this Court and conclusion of the trial is likely to take some time. Therefore, the present applicant may also be granted privilege of regular bail.
4. On the other hand, learned counsel for the State opposed the bail application.
5. I have heard learned counsel for the parties and perused the material available on record.
6. Having considered the order dated 26.08.2022 passed by this Court in MCRC No. 6216 of 2022, looking to the allegation against the present applicant, detention period and that conclusion of the
3 trial is likely to take some time, without commenting anything on merits of the case, this Court is inclined to release him on regular bail.
7. Accordingly, the bail application is allowed.
8. It is directed that the applicant shall be released on bail on his executing a personal bond for a sum of Rs.1,00,000/- with two local sureties of Rs.50,000/- each to the satisfaction of the trial Court for his appearance before the said Court as and when
directed, till disposal of the trial. Certified copy, as per rules. Sd/-
