JUSTICE AHANTHEM BIMOL SINGH O R D E R 28-01-2025 Heard Syed Murtaza Ahmad, learned counsel appearing for the petitioners and Mr. Y. Nirmolchand, learned senior counsel assisted by Mr. L. Raju, learned counsel appearing for the respondent. In the present writ petition, the petitioners claimed that they were given promotion by the orders dated 28-06-2022 w.e.f. 30-06-2022 in the following capacities:- (i) Petitioner No. 1 was promoted as Deputy Secretary in COHSEM; (ii) Petitioners No. 2 and 3 were promoted as Under Secretary (IT) in COHSEM. (iii) Petitioner No. 4 was promoted as Section Officer & (iv) Petitioner No. 5 was promoted as Assistant Section Officer. The prayer made by the petitioners in the present writ petition is for issuing a direction to the respondents to take up an exercise to verify as to whether they were given promotion as stated hereinabove and whether they are entitled to get the pay scale of the higher posts against which they were promoted with effect from the date they were given promotion to the said posts. Mr. Y. Nirmolchand, learned senior counsel appearing for the respondent fairly submitted that the respondent will carry out an exercise for verifying the claims made by the petitioners and in the event, they are found to have been promoted against the posts claimed by them w.e.f. 30-06-2022, necessary steps will be taken for releasing their pay and allowances entitled to them for the posts against which they have been promoted. In view of the submission made above, this court is of the considered view that interests of justice will be served by issuing the following directions:- (i) The respondent is hereby directed to carry out an exercise to verify as to whether all the petitioners have been promoted against the posts mentioned hereinabove w.e.f. 30-06-2022 within a period of one month from today; (ii) In the event, if it is found that they were given such promotion w.e.f. 30-06-2022, the respondent is directed to release the arrear pay and allowances due payable to them for the posts against which they were promoted with effect from the date they were given such promotion; and (iii) Such exercise should be completed within a period of three months from today. With the aforesaid directions, the present writ petition is disposed of. JUDGE Devananda -2-
