Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of the Respondents without following the due process of law trying to lay the road in their lands in Sy.No.196 to an extent of Ac.0-18 cents situated in Manindram Village, Ramakiippam Mandal, Chittoor District, as illegal, arbitrary, besides violation of principles of Natural Justice, consequently dirqct the Respondents not to interfere into the Petitioners peaceful possession and enjoyment of the said property in Sy.No.196 to an extent of Ac.0-18 cents situated in Manindram Village. Ramakuppam Mandal, Chittoor District, forthwith and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to interfere into the petitioners’ lands in Sy.No.l96 to an extent of Ac.0-18 cents situated in Manindram Village. ORDER:
1. The present writ petition is filed for following relief: <…to issue a writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of the Respondents without following the due process of law trying to lay the road in their lands in Sy.No.196 to an extent of Ac.0-18 cents situated in Manindram Village, Ramakuppam Mandal, Chittoor District, as illegal, arbitrary, besides violation of principles of Natural Justice, consequently direct the Respondents not to interfere into the Petitioners peaceful possession and enjoyment of the said property in Sy.No.196 to an extent of Ac.0-18 cents situated in Manindram Village. Ramakuppam Mandal, Chittoor District, forthwith and pass such other order or orders….=
2. On instructions, the learned Government Pleader for Revenue has submitted that the subject property is Rastha Poramboke and the petitioner is the adjacent owner and he encroached upon an extent of Ac.0.18 cents of Rasta land.
3. Considering the aforesaid submissions, the writ petition is
disposed of directing the respondents not to dispossess the petitioner from the subject property without following due process of law. However, if it is found that the petitioner has encroached upon any public property, the respondents are at liberty to initiate appropriate proceedings under the provisions

of the Land Encroachment Act, 1905 and take necessary action in accordance with law. No costs.
