ORAL ORDER
Heard Shri S.S. Srinivasa Rao, learned counsel appearing for the petitioners; Shri Channappa Erappa, learned High Court Government Pleader appearing for respondent No.1 and Shri Manjunath B.R., learned counsel appearing for respondent No.2 and have perused the material on record. 2. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have

filed a joint memo along with an affidavit. The joint memo reads as follows:
"JOINT MEMO
The Petitioners and Respondent No.2 respectfully submit as follows:
1. The Petitioners have filed the above Petition seeking to quash the entire proceedings in C.C No.23541/2019 for the offences punishable under Sections 120(B), 201, 420, 465, 468, 471, 506 of Indian Penal Code, 1860, pending on the file of the LXI Additional Judicial Magistrate, arising out of Crime No. 137/2019 registered by Cubbon Park Police Station. 2. The Petitioners had preferred similar Petitions seeking to quash the aforesaid proceedings wherein Petitioner No.1 to 4 had filed Crl.P No.6632/2020 and Petitioner No.5 had filed Crl.P No.6969/2021, which came to be dismissed vide common order dated 20.12.2023. The Petitioner subsequently questioned the said order in SLP(Crl) No. 3668-3669/2024 and SLP(Crl) No. 11089/2024 wherein the Hon'ble Apex Court while dismissing the SLP was pleased to observe that Petitioners can avail the remedy for discharge before the trial court vide common order dated
14.10.2024. 3. The Petitioners and Respondent No.2 and subsequently resolved their dispute and have arrived at a settlement on the advice of friends and well-wishers. 4. The 1 Petitioner, in furtherance of arriving at a settlement has agreed to pay a compensation of Rs. Fifty Lakhs to the Respondent No.2 on behalf of all the Petitioners and in furtherance of the same, has got issued a Demand Draft dated 15.07.2025 bearing No.006043 drawn on Axis

Bank, Panathur Branch, in favour of Respondent no. 2. 5. The 2nd Respondent, upon receipt of the aforesaid Demand Draft withdraws all allegations against the Petitioners and does not wish to further precipitate the matter against the Petitioners and has no objection towards closure of the entire proceedings in C.C No.23541/2019 against the Petitioners.
The 2nd Respondent shall not precipitate other complaints that may be pending in relation to the present transaction. 6. The 5th Petitioner shall withdraw the proceedings in CCC No.216/2023 pending before the Hon'ble High Court of Karnataka, Bengaluru upon closure of entire proceedings in C.C No.23541/2019 against the Petitioners. 7. Neither of the parties shall make use of any document/record which is part of the transactions giving rise to the dispute/litigation between the parties, in future against each other. The parties undertake not to indulge in any act, directly or indirectly, which may cause any pecuniary loss or loss of reputation to each other. It is further made clear that this settlement shall not in any manner be shown or relied upon by any party in any other dispute/proceedings that may be pending or that may arise on account of facts and circumstances unrelated to the present transaction. Wherefore, the Petitioners and Respondent No. 2 respectfully pray that in terms of the aforesaid settlement, this Hon'ble Court may be pleased to quash the entire proceedings in C.C No.23541/2019 for the offences punishable under Sections 120(B), 201, 420, 465, 468, 471, 506 of Indian Penal Code, 1860, pending on the file of the LXI Additional Judicial Magistrate, arising out of Crime No. 137/2019 registered by Cubbon Park Police Station, in the interest of justice."

3. In the light of the settlement arrived at between the parties, I deem it appropriate to accept the joint memo and close the proceedings against the petitioners in the subject petition. 4. The crime so registered against these petitioners as well as the charge sheet so filed pursuant to the crime in C.C.No.23541/2019 stands quashed. 5. For the aforesaid reasons, the following:
ORDER i) Criminal Petition is disposed. ii) Proceedings in C.C.No.23541/2019 pending before the LXI Additional Judicial Magistrate, stands quashed qua the petitioners.
