JUSTICE SURAJ GOVINDARAJ - 3 - HC-KAR NC: 2025:KHC:49037 WP No. 32888 of 2025 ORAL ORDER 1. The Petitioner is before this Court seeking for the following reliefs; a. Issue writ of certiorari or any other appropriate writ or direction, quashing the order dated 10.10.2025 passed by the 2nd respondent in No.AA NA SA 16 ECA 2016w (25578) at Annexure- H and b. Grant such other relief or reliefs as this Hon'ble Court deems fit to grant in the circumstances of the case. 2. The grievance of the Petitioner is that without hearing the petitioner, the impugned order dated 10.10.2025 has been passed by Respondent No.2. 3. Learned AGA was called upon to secure the original file to verify if the Petitioner has been heard in the matter. On verification, learned AGA submits that the Petitioner has not been heard. 4. In that view of the matter, I am of the considered opinion that the principles of natural justice have not been complied with and that the Petitioner has been - 4 - HC-KAR NC: 2025:KHC:49037 WP No. 32888 of 2025 denied the benefit of having his say in the matter before an order was passed. As such, I pass the following: ORDER i) Writ petition is allowed. ii) A certiorari is issued, the order dated 10.10.2025 passed by Respondent No.2 at Annexure-H, is quashed insofar as the Petitioner is concerned. iii) The matter is remitted back to Respondent No.2 for fresh consideration insofar as the Petitioner is concerned. iv) The Petitioner shall appear before Respondent No.2 without requirement of any further notice on 09.12.2025 at 2-30 p.m., to file his statement of objection and address his - 5 - HC-KAR NC: 2025:KHC:49037 WP No. 32888 of 2025 arguments, if necessary, on the very same date. v) Until an order is passed by Respondent No.2, the Petitioner shall be entitled to operate the authorization.
