It is submitted that despite arrival of police force, the people of Muslim community became more agitated and started pelting stones on the policemen and became adamant and despite being requested by the police, they did not stop and due to which there is an atmosphere of fear among the Hindu people. 4. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this case and nothing has happened as alleged in the FIR. The real facts of the case is that some persons has committed incident and run away but, those who are not involved in the present occurrence, they were stayed in their house and they have not committed any crime, but the police illegally arrested them including the applicant and implicated in the present case. Applicant has no motive to commit the alleged offence. He has no criminal antecedent. There is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for. 5. Learned AGA has vehemently opposed the prayer for bail but could not dispute the aforesaid facts. 6. Considering all above facts and circumstances, the nature of accusations, severity of the punishment in the case of conviction and nature of supporting evidence, reasonable apprehension of tampering with the witness and prima facie case, but without commenting on merit of case, a case for bail is made out. 7.
