The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Criminal Case No. 2429 of 2023, (State Vs. Smt. Maisar and others) arising out of Case Crime No. 416 of 2022, under Sections 354, 323, 504, 506 of I.P.C., Police Station- Kotwali Dehat, District- Saharanpur, as well as cognizance/ summoning order dated 24.07.2023 pending in the Court of Additional Chief Judicial Magistrate, Ist, Saharanpur. As per prosecution case, there are two incidents. After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicants after retaining a xerox thereof.
