Hon'ble Shri Ramesh Sinha, Chief Justice Hon'ble Shri Arvind Kumar Verma , Judge Order on Board Per Ramesh Sinha, Chief Justice 0 8/ 04/2025 1 Proceedings of this matter have been taken through Video Conferencing. 2 Heard Mr. Prafull N Bharat, learned Advocate General assisted by Mr. Shashank Thakur, learned Deputy Advocate General for the State/respondents. 3 The petitioner has prayed for the following relief(s): “10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent to mitigate the problems which happened in short circuits and damages occurred to the public life and property. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to use the electrical wires in an underground manner by which short circuits will be prevented. 10.3 That this Hon’ble Court may kindly be pleased to grant any other relief which may deem fit in the facts and circumstances of the case.” 3 4 From perusal of the pleadings, it transpires that the petitioner is a resident of Yadunandan Nagar, Tifra, Bilaspur. He is aggrieved by the issues relating to massive hazardous electric failure due to short circuits during rainy season and summer and in the night of thunderbolts. The petitioner had sent legal notices to the respondent authorities and informed about the situation because of which short circuits were caused in the electrical poles which are being unauthorisedly used by the cable operators, internet service providers and regarding which numerous complaints have been made but nothing was done. 5 On 19.12.2024, this Court had directed the Secretary, Department of Energy, Government of Chhattisgarh to file his personal afÏdavit with regard to the issues raised in this petition. Since another petition being WPPIL No. 3/2025 was registered suo moto by this Court on the basis of a news item, and since the Superintending Engineer (for short, SE), Chhattisgarh State Power Distribution Company Ltd. (for short, CSPDCL) had filed an afÏdavit stating therein that the electrical wires and the cable wires including the internet wires were properly arranged and steps were taken for proper management and maintenance of the electrical poles so that no untoward incident occurs in future. On the last date of hearing i.e. on 24.02.2025 also, this Court had taken note of the afÏdavit filed by the SE, CSPDCL and the matter was directed to be listed today alongwith the fresh afÏdavit of the SE, CSPDCL. 6 Mr. Bharat, learned Advocate General submits that now the situation is much better and the grievance raised by the petitioner seems to be redressed. 7 Today, none appears on behalf of the petitioner. On the last occasion also i.e. on 24.02.2025, none had appeared. In light of the afÏdavit filed 4 by the SE, CSPDCL, which has been taken note of by this Court in its order dated 24.02.2025, and further the compliance report filed by the SE, CSPDCL, in WPPIL No. 3/2025, vide IA No. 2/2025, which shows a better picture of the current situation with respect to the electrical poles and wires, this Court is of the view that nothing survives in this petition and as such, this petition stands disposed of.
