The Court made the following ORDER: // THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 4151 OF 2025 ORDER: The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A2 to grant anticipatory bail in connection with Crime No. 199/2025 of Prohibition and Excise Station, Rajamahendravaram South, East Godavari District. 2. A case has been registered against the petitioner and other for the offences punishable under Sections 7-B read with 8-B of the A.P.Prohiniton (Amendment) Act, 2020. Case of the prosecution in brief is that on 08.4.2025 at about 10.30 am, on receipt of credible information, the Proh. & Excise, Sub Inspector of Rajamahendravaram South police station, along with staff, reached near Vinayaka temple of Kothapeta located in the G.Yerrampalem Village of Rajnagaram Mandal and found one person coming towards the raid party with mica hand bag holding in his right hand. Upon seeing the raid party, the person tried to escape from the place but the raid party stopped him and on enquiry, he stated that the bag contains ID liquor. Then the raid party verified and found 05 liters of •ID Liquor with strong smell. On questioning him, he disclosed his identity particulars as that of Aland also stated that he purchased the above ID 3. 2 Liquor from A2 for lower price and accordingly to sell at higher price at his residence. A1 was arrested and after observing all formalities, he was remanded to judicial custody. A1 confessed about the involvement of another accused in the commission of the offence. Heard. Perused the record. 4. A perusal of the material available on record goes to show that, all 5. the allegations are directed against A1 only. In view of the facts and circumstances of the case, this Court is inclined to consider the prayer of the petitioner for grant of anticipatory bail. Accordingly, in the event of his arrest with regard to this crime 6. petitioner/A2 shall be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials and also on condition that the petitionershall make himself available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. ir /■ 3 The petitioner shall appear before the Station House Officer concerned, once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge-sheet.
