Heard learned counsel for the petitioner and learned AGA for the State-respondents. 2. Contention of learned counsel for the petitioner is that the petitioner having remained in jail actually for a period of 21 years and one month was entitled for remission. He submitted that as per United Provinces Prisoners Release on Probation Act, 1938, Section 432 of the Criminal Procedure Code, 473 of the BNSS and as per the Uniform Policy on Remission for State of U.P., the petitioner was entitled for remission. 3. From the record, we find that there is no application which has been filed by respondent no. 4. 4. In such circumstances, if the petitioner files an application before the respondent no. 2 for the relief, for which this petition has been filed, the application shall be considered by the respondent no. 2 within a period of two months from the date of the application. It may be mentioned that the application be sent to the respondent no. 2 through the Jail Superintendent, Central Jail, Varanasi. 5. The writ petition is disposed of.
