1. Heard learned counsel for the applicants, learned AGA for the State and learned counsel appearing for the opposite party no.2.
2. This application under Section 482 Cr.P.C. has been preferred for quashing of the entire proceedings, including summoning order dated 27.08.2021, of Complaint Case No. 3921/2024 (old no.292/2021) [Arpit Verma v. Anshul Verma and others), under Sections 323, 341, 356, 504, 506 IPC, P.S.- Kamalganj, District- Farrukhabad, pending in the court of Additional Civil Judge (S.D.), District- Farrukhabad, on the basis of compromise arrived at between the parties.
3. It has been submitted by learned counsel for the applicants that the impugned complaint has been lodged by the son-in-law of applicant no.1. There was some matrimonial dispute between daughter of applicant no.1 and opposite party no.2 and now both the parties have amicably settled their dispute and compromised the case. The opposite party no.2 has already filed short affidavit stating that he does not want to prosecute the present applicants. It was stated that in view of these facts and circumstances, no useful purpose would be served by keeping the impugned proceedings pending and thus, the impugned proceedings may be quashed on the basis of compromise arrived at between the parties.
4. Learned counsel for the opposite party no.2 has concurred with
arguments of learned counsel for the applicants and submitted that both the parties have compromised the matter and they have settled all disputes. The complainant does not want to pursue the impugned proceedings and thus, the impugned proceedings may be quashed on the basis of the compromise between the parties.
5. It is well-settled that in appropriate cases criminal proceedings may be quashed on the basis of compromise between the parties. In the instant matter, applicant no.1 is father-in-law of opposite party no.2 and remaining applicants are his family members/relatives. The dispute between the parties is private in nature. If parties compromise the matter, it would not have any adverse affect on the society. The short counter affidavit of opposite party no.2/complainant is on record, wherein he has stated that he does not want to prosecute the applicants. Considering the facts of the matter, it would be in the interest of justice that the impugned proceedings be quashed.
6. In view of aforesaid, the entire impugned proceedings, including summoning order, of the aforesaid case against applicants, namely, Dinesh Chandra Verma, Anshul, Ankit, Rakesh Verma, Manish, Dinesh Chandra, Radha Raman and Vijay Kumar are hereby quashed.
7. The application under Section 482 Cr.P.C. is allowed.
