p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.11547 of 2025 Gunjan Dalai … Petitioner Mr. B.S. Das, Advocate -versus- State of Orissa … Opposite Party Mr. T.K. Acharya, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 12.01.2026 02. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Chhatrapur PR Case No.326 of 2024-25 corresponding to 2(a) CC Case No.11 of 2025 pending in the file of learned Addl. Sessions Judge-cum-Special Judge, Khallikote, Ganjam for commission of offences punishable U/Ss.20(b)(ii)(C) of NDPS Act, on the main allegation of transporting 53Kgs of Contraband Ganja in a Maruti Suzuki EECO Star Car bearing Regd. No.OD- 02-V-4492. 3. Heard Mr. B.S. Das, learned counsel for the petitioner and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record including the copy of deposition PW.1. 4. After having considered the rival submissions and taking into consideration the nature and gravity of p. 2 the offence as alleged against the petitioner vis-à-vis the accusation sought to be brought against him and regard being had to the seizure of 53Kgs of Contraband Ganja, which is well above the commercial quantity keeping in view the evidence of PW.1 and taking into account the consequent failure of the petitioner to satisfy the conditions of Sec.37 of NDPS Act, this Court is not inclined to grant bail to the petitioner. 5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of the order be immediately communicated to the learned trial Court. (G. Satapathy) Judge Jayakrushna
