Neutral Citation No. - 2025:AHC:61001 Court No. - 35 Case :- WRIT - C No. - 12082 of 2025 Petitioner :- Nadeem And 26 Others Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Indra Mohan Singh,Rajesh Kumar Singh Counsel for Respondent :- C.S.C.,Krishna Kant Singh Hon'ble Manish Kumar Nigam,J.
1. Impleadment application filed by Sri Virendra Singh, learned counsel appearing on behalf of the complainant, is taken on record.
2. Heard learned counsel for the parties and perused the record.
3. This writ petition has been filed for the following reliefs:-
"1) issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 15.2.2025 passed by respondent Sub Divisional Officer (contained in Annexure No.1 to writ petition); (II) issue a writ, order or direction in the nature of mandamus directing respondent to consider the matter afresh, after inquiring into the matter only to the extent of legal impediment for approval of proposed agricultural lease in favour of petitioners as directed by this Hon'ble Court under order dated 18.11.2024 in Writ-C No.19777 of 2024, Basanto & others versus Nadeem & others (contained in Annexure No.10 to writ petition);"
4. By means of the order impugned, the approval to the proposal for grant of lease has been rejected.
5. Contention of learned counsel for the petitioners is that the order is cryptic in nature and does not decide anything despite a direction being given by this Court earlier in Writ -C No. 19777 of
2024.
6. A preliminary objection has been raised by learned Standing Counsel that against the order impugned, the petitioners have alternative remedy of filing a revision under Section 210 of U.P. Revenue Code, 2006.
7. In view of the availability of statutory alternative remedy, I am not inclined to interfere in the matter.
8. Accordingly, the writ petition is disposed of with liberty to the petitioners to avail the remedy as available to them under the U.P. Revenue Code, 2006. Order Date :- 23.4.2025 Nitika Sri. (Manish Kumar Nigam,J.) Digitally signed by :- NITIKA SRIVASTAVA High Court of Judicature at Allahabad
